These Terms & Conditions ("Terms") govern your access to and use of 1to1wish.org and any related services (together, the "Site"), operated by 1to1WiSh, a 501(c)(3) nonprofit organization ("1to1WiSh," "we," "us," or "our"). By creating an account, posting a wish, requesting a wish, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old to create an account or post a wish on 1to1WiSh. If you are registering on behalf of an organization (such as a hospital, school, business, or nonprofit), you confirm that you are authorized to act on that organization's behalf and to bind it to these Terms.
2. What 1to1WiSh Is — and Isn't
1to1WiSh is a platform that helps people connect directly to give or request items, time, or skills. We are a connector, not a party to any exchange. When you grant or request a wish, the resulting arrangement is solely between you and the other user(s) involved. 1to1WiSh does not own, inspect, warehouse, ship, insure, or guarantee any item, service, or commitment exchanged through the Site, and we are not responsible for the condition, safety, legality, or delivery of anything exchanged between users.
3. Your Account
- You agree to provide accurate, current information when registering, and to keep it up to date.
- You're responsible for maintaining the confidentiality of your password and for all activity under your account.
- You agree to notify us promptly of any unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms, that are used fraudulently, or that we reasonably believe pose a risk to other users.
4. Posting a Wish
When you post a wish — whether granting or requesting — you agree that:
- Your listing will be honest, accurate, and not misleading about the item, service, condition, location, or your intentions.
- Photos you upload are your own or that you have the right to use them, and do not contain content that is graphic, sexual, or otherwise inappropriate.
- You will not use a wish listing to advertise a for-profit sale, solicit unrelated business, or collect personal data from other users beyond what's needed to complete the exchange.
- You are solely responsible for any promises made in connection with your listing, including "pay it forward" commitments you describe — these are goodwill intentions between users, not obligations enforced by 1to1WiSh.
Prohibited listings. You may not use 1to1WiSh to post, request, or exchange: illegal items or services of any kind; weapons, ammunition, or explosives; alcohol, tobacco, or controlled substances; counterfeit or stolen goods; live animals (outside of legitimate rehoming through a recognized shelter or rescue, at our discretion); hazardous, recalled, or unsafe materials; or anything intended to defraud, harass, or exploit another person. We reserve the right to remove any listing, at any time, for any reason, including listings that violate this section.
5. Monetary Donations
Monetary donations made through the Site are processed by our third-party payment partner, Zeffy, and are used to support 1to1WiSh's operations and growth as a nonprofit organization — they are not allocated to fund individual users' wishes. Donations are generally non-refundable except as required by law or at our discretion. As a 501(c)(3) organization, eligible donations may be tax-deductible; you will receive a receipt from Zeffy or 1to1WiSh for your records, and we recommend consulting a tax professional regarding your specific situation.
6. Code of Conduct
You agree not to use the Site to:
- Harass, threaten, discriminate against, or abuse another user.
- Impersonate any person or organization, or misrepresent your affiliation with one.
- Upload viruses, malicious code, or attempt to interfere with the Site's security or normal operation.
- Scrape, harvest, or misuse other users' contact information or listing data.
- Use the Site for any purpose that is unlawful or prohibited by these Terms.
7. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not verify the identity, background, or trustworthiness of users beyond the registration information they provide, and we do not guarantee that any wish posted will be fulfilled, or that any item exchanged will be safe, suitable, or as described. You are responsible for exercising your own good judgment — including meeting in safe public locations, inspecting items before accepting them, and declining any exchange that feels unsafe or inappropriate.
8. Limitation of Liability
To the fullest extent permitted by law, 1to1WiSh and its officers, directors, volunteers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of goods, data, goodwill, or other intangible losses, resulting from your use of the Site or any exchange arranged through it — including damages arising from another user's conduct, an item's condition, or a failed or disputed exchange. Our total liability for any claim arising from these Terms or your use of the Site will not exceed $100.
9. Indemnification
You agree to indemnify and hold harmless 1to1WiSh and its officers, directors, and volunteers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your listings, your violation of these Terms, or your exchange with another user.
10. Intellectual Property
The 1to1WiSh name, logo, and Site design are the property of 1to1WiSh and may not be used without our written permission. You retain ownership of any content (such as listing text and photos) you post, but by posting it, you grant 1to1WiSh a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content in connection with operating and promoting the Site.
11. Third-Party Services
The Site relies on third-party services, including Netlify (hosting and form processing), Zeffy (donation processing), and Google Translate (the language switcher). Your use of these features may be subject to those providers' own terms and privacy policies, which we encourage you to review.
12. Termination
You may stop using the Site and request deletion of your account at any time by contacting us. We may suspend or terminate your access to the Site, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or to 1to1WiSh.
13. Changes to These Terms
We may update these Terms from time to time. We'll post the revised Terms on this page with an updated effective date. Continuing to use the Site after changes take effect means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law principles, unless otherwise required by applicable law.
